1. Acceptance of Terms

By accessing and using the services provided by Brain Board – Digital Consultancy and Web Services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Brain Board provides digital consultancy and web services including, but not limited to, website development, digital strategy, and related consulting services. The specific scope, deliverables, and terms of each service will be defined in individual service agreements.

3. Client Responsibilities

Clients are responsible for:

Providing accurate and complete information necessary for service delivery
Reviewing and providing feedback on deliverables in a timely manner
Maintaining the confidentiality of any access credentials provided
Ensuring they have necessary rights to any content provided to Brain Board

4. Intellectual Property Rights

4.1 Client Content

Clients retain all rights to their original content, including logos, text, images, and data provided to Brain Board.

4.2 Brain Board Content

Unless explicitly stated otherwise in writing, Brain Board retains intellectual property rights to:

Custom code and technical solutions developed
Design elements and creative works
Methodologies and processes used in service delivery

5. Privacy and Data Protection

We process personal data in accordance with Swiss data protection laws and the EU General Data Protection Regulation (GDPR) where applicable. For detailed information, please refer to our Privacy Policy.

6. Payment Terms

Payment terms will be specified in individual service agreements
All prices are in Swiss Francs (CHF) unless otherwise stated
Invoices are due within 30 days of issuance
Late payments may incur additional fees

7. Liability and Warranties

7.1 Service Warranty

Brain Board warrants that services will be performed in a professional manner consistent with industry standards.

7.2 Limitation of Liability

Our liability is limited to the amount paid for the specific service in question. We are not liable for:

Indirect, consequential, or incidental damages
Loss of profits or business opportunities
Data loss or corruption
Third-party claims

8. Termination

Either party may terminate services with written notice according to the terms specified in individual service agreements. Upon termination:

All outstanding payments become immediately due
Access to ongoing services will be discontinued
Client data will be returned or destroyed as specified in the service agreement

9. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of service delivery. This obligation survives the termination of services.

10. Governing Law and Jurisdiction

These terms are governed by Swiss law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland.

11. Changes to Terms

Brain Board reserves the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of services constitutes acceptance of modified terms.
